Consumer Health Data Privacy Notice

This notice describes how Epicalin, LLC, the owner and operator of Hummingly, handles consumer health data, including under Washington's My Health My Data Act and Nevada's consumer health privacy law.

Categories and sources

Hummingly does not track listening minutes, collect clinical records, or connect to device health services. Selected creative intent and binaural audio settings can be stored as app preferences. This notice covers health related information you voluntarily include in creative content or support requests.

Affirmations, prompts, lyrics, titles, generated music, style choices, and optional support or report details may reveal physical or mental health information if you choose to include it. Generated content or safety classifications may reflect that information. These records may be associated with your account identifier or the contact information you supply. Sources are you, content generated in response to your requests, and other users when they privately share content with you. We do not obtain health records from data brokers, infer a clinical diagnosis, or collect precise location to identify visits to health services.

Purposes

We process relevant information to provide the features you request: creating and checking lyrics and music, playing and organizing your library, syncing or backing up supported creative content, privately sharing at your direction, and answering support or safety reports. We also protect the security and integrity of these features. We do not sell consumer health data or use it for advertising or unrelated profiling.

Categories shared and recipients

With your separate AI permission, creative fields that may contain health information are sent to Google Gemini and Google Lyria for generation and safety processing. Our private audio processor handles audio and lyrics for alignment and vocal separation. Cloudflare provides hosting, network protection, protected storage and email infrastructure for the service data needed for these functions. Authorized support and moderation personnel can access the limited records needed to handle your request or report.

At your direction, iCloud or Google Drive receives supported creative content you choose to back up; and the private recipients you select receive the content you share. We may disclose data when legally required. We do not share consumer health data with corporate affiliates. We do not sell it.

Consent, withdrawal and deletion

You can decline AI processing before entering creative content, or withdraw AI permission in Hummingly Settings. Withdrawal stops new AI requests and cancels unfinished jobs where possible, but cannot recall a provider request already sent. You can disable optional sync or backup and revoke private shares in the app. These choices do not discriminate against you; the feature that needs the declined processing will be unavailable.

Request access, confirmation of processing, a copy, correction, deletion, or withdrawal by emailing hello@hummingly.app with the subject “Privacy Request.” You may also delete your account in the app or follow the account deletion instructions. We verify requests using information reasonably necessary to protect your account and accept an authorized agent where required. Where applicable, you may request the third parties and affiliates to which your consumer health data was shared. We carry out valid deletion requests and notify relevant processors and other recipients as required by law, subject to applicable legal exceptions and backup deletion periods.

We respond within the period required by applicable law, generally within 45 days, and explain any legally permitted extension. If we refuse a request, we explain the decision and how to appeal. Reply with the subject “Privacy Appeal.” You may complain to the Washington State Attorney General or the Nevada Attorney General.
